The applicant can file an international trademark application via the Madrid system of World Intellectual Property Organization (WIPO), to protect your trademark in all or any of the members of the Madrid Union, including Vietnam.
In case the applicant is an individual who has a national of or settled in Vietnam, or an organization has a domicile or business in Vietnam, you can choose the Intellectual Property Office of Vietnam (IPVN) as your "Office of origin".
Before filing an international trademark application, the applicant must register – or apply for – a national trademark through the office of origin. This national trademark is called a "basic mark" and is the requirement to enjoy the right to register an international trademark under the Madrid Agreement.
Requirements for filing International Trademark Registration via Madrid system:
1. Information on “basic mark”: registration application or certificate number and notarized application/certificate..
2. Full name, address, and nationality of the applicant(s).
3. Power of Attorney (POA) signed by the applicant(s) (notarization/legalization is not required).
The soft copy of the POA is acceptable at the filing date. The deadline for submitting the original is 1 month from the filing date, non-extendable.
4. Trademark specimen in .jpg format. The mark size should be no smaller than 8mm x 8mm.
5. List of Contracting Parties (all or any member of the Madrid Union) in which the applicant would like to protect the mark.
6. Declaration on intention to use the mark if any contracting party requests (notarization/legalization is not required).
